  About this document

This is a very straightforward, yet effective and popular will. First, the testator can give gifts to anyone, as specified.  60% of what is left, is given to the spouse or life partner, for his or her life to do as they please.  They may use it as they wish, they may even spend it all.  If that is the case, the other 40% is given directly to the children, so the children are well catered for.  If there is capital left when the surviving spouse dies, that then passes to the children too.

This will document also includes a specific provision for the life partner or spouse to be able to occupy the matrimonial home.  It includes wide trust powers, however, may fail to preserve capital.  So as long as the 40% you provide to your children is satisfactory in your case, the fact that the spouse may not preserve the capital is not an issue because the children are still provided for.

This will document is most suited to a person living with someone other than a parent of their children.

The Net Lawman wills are suitable for most situations.  If the will you need is not here, we can draw a will to your precise instructions for a very reasonable fee.

In these descriptions: “remainderman" means the person entitled to capital and any accumulated income after the death of a person with a life interest (a “tenant for life”).
