About this document
This will document allows the testator to give specific gifts or personalty or real estate to anyone. The main estate passes to the spouse or life partner. If the spouse does not out live the testator, then half of the trust passes to nominated child guardians and the other half passes to the children. Of course this second half will still be held on trust if the children are minors. It allows for the children to receive trust income and trust capital, should it be for their advancement.
The effect of this is that the surviving parent receives the entire estate and can use that to maintain themselves and the children. Should both parents die, the half the estate passes to guardians who then have the money to spend on the upbringing of the children and the other half is kept on trust for the children so they have some financial standing when they become adults.
This will document is most suited to a young parent, or parents, and is especially useful to cover the case of an unexpected accident.
